A combined report released by APIL and the Trades Union
Congress (TUC) has concluded that concerns over a growing compensation culture
are unfounded because the overwhelming majority of people who have been injured
at work haven’t received a penny.
APIL and TUC believe that every year there are in excess of
600,000 individuals who suffer injury or fall ill as a consequence of their job,
a staggering 25,000 of which have to stop working as a result.
President of APIL, Matthew Stockwell, said: “85% of people
who have been injured or fallen ill simply by turning up for work don’t receive
a penny in compensation.
“Either these injured people are choosing not to claim, or
they can’t prove that their injury is due to someone else’s negligence.
Unfortunately, employers tend to have the upper hand, as they control the
workplace and have all the information on the equipment and systems in place.
So there will be people who have a need and a right to claim but can’t, which
is precisely the opposite of a so-called ‘have-a-go’ culture.”
APIL and TUC also pointed out that claims registered with
the government compensation recovery unit have fallen by more than half in the
last 10 years.
Zen Law is a legal company in Manchester with a focus on
personal injury claims. They regularly share their thoughts on news and
research related to their line of work.
A spokesperson for Zen Law said: “We’ve suspected for a long
time, based on our own experience in the industry, that this supposed
prevailing ‘compensation culture’ doesn’t have much of a basis in reality. The
fact is that most people do not report injuries in the workplace because they
wrongly believe it’s too much hassle, they don’t realise that they’re entitled
to compensation, or they fear making a claim because they believe they’ll be
greeted with suspicion. And there are also those who are wary or jeopardising
their employment by making a claim.
“We would 100% recommend getting in touch with us if you’ve
had an accident at work or fallen ill as result of your job. The days of
workers being entitled to nothing are long gone. There’s ample support out
there and with our help you could be paid the compensation that you deserve.”
